DePuy Concurs With Pinnacle MDL But Recommends Alternate Venue
DePuy Orthopaedics, a subsidiary of Johnson & Johnson, has yet to implement a DePuy Pinnacle recall, though recent actions indicate that the company favors consolidating all federal Pinnacle lawsuits through the process of multidistrict litigation (MDL).
A petition was filed by Catherine Falvey in March for all federal DePuy Pinnacle lawsuits to be localized in the United Stated States District Court for either the Southern District of Texas or the Central District of California. By April 18th, DePuy responded to that petition and agreed that Pinnacle lawsuits should undergo MDL. However, the company suggested that the MDL take place in the United States District Court for the Northern District of Texas.
